Grove Ridge Terms of Use

These Terms of Use ("Terms") are an agreement between you and Long Software LLC ("Long Software", "we", "us"). They cover your use of the Grove Ridge mobile game and its related web pages (together, "Grove Ridge"). By downloading or playing Grove Ridge, you agree to these Terms. If you don't agree, please don't use Grove Ridge.

1. Who can play

Grove Ridge is rated 12+ (App Store) and Teen (Google Play). It is not directed at children under 13. If you are under the age of majority where you live, please review these Terms with a parent or guardian. In-app purchases by minors should be made with a parent's or guardian's permission.

2. License to use the game

  • We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Grove Ridge for your own non-commercial entertainment, on devices you own or control.
  • iOS: if you got Grove Ridge from the Apple App Store, Apple's Licensed Application End User License Agreement ("Standard EULA") also applies, as do the App Store's Usage Rules, including Family Sharing. If these Terms conflict with the Standard EULA, the Standard EULA controls for iOS.
  • Android: if you got Grove Ridge from Google Play, the Google Play Terms of Service also apply to your download and purchases.
  • We may update, change, or stop offering Grove Ridge or any feature at any time. Some features need an internet connection.

3. In-app purchases and virtual items

  • Grove Ridge offers optional in-app purchases: an item that removes forced (interstitial) ads, and cosmetic skins ("Virtual Items").
  • Virtual Items have no cash value. They can't be exchanged for money or anything else of value, sold, or transferred, except through platform features such as Family Sharing where those apply. They grant a license to use the item in the game, not ownership of it.
  • "Remove forced ads" removes interstitial ads shown between levels. Rewarded ads, which you can choose to watch for extra undos, stay available and are always optional.
  • Apple or Google processes all payments, under their own terms. Prices are shown in the store before you buy.
  • Refunds are handled by Apple or Google under their refund policies:

    We can't issue refunds directly. This doesn't affect any rights you have under consumer law.

  • Restoring purchases: you can restore non-consumable purchases on a new device signed in to the same store account, using Restore Purchases in the game's settings. [ENGINEERING TO CONFIRM.]

4. Ads

Grove Ridge is free to play and supported by ads served by Google AdMob. Ads may be personalized or non-personalized, depending on your choices and where you live. Our Privacy Policy explains how to change these choices. We aren't responsible for advertisers' products, services, or websites. If you see an inappropriate ad, use the ad's feedback or "AdChoices" option, or email us.

5. Acceptable use

You agree not to:

  • cheat, hack, or modify the game, or use bots, exploits, or unauthorized third-party software;
  • tamper with ads or purchase verification, block or fake ad views to obtain rewards, or commit ad fraud;
  • copy, decompile, reverse engineer, or create derivative works of the game, except where the law expressly allows it;
  • rent, sell, sublicense, or commercially exploit the game or its content; or
  • use the game in violation of any law, or of the terms of your app store or device provider.

6. Intellectual property

Grove Ridge and all its content, including the game design, levels, artwork, music, code, and the "Grove Ridge" and "Long Software" names and logos, are owned by Long Software LLC or its licensors and protected by intellectual property laws. Except for the license in section 2, these Terms don't give you any rights in them. If you send us feedback or ideas, you allow us to use them without any obligation to you.

7. Privacy

Our Privacy Policy explains what information is collected when you use Grove Ridge and the choices you have.

8. Disclaimers

To the maximum extent permitted by law, Grove Ridge is provided "as is" and "as available", without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the game will be uninterrupted, error-free, or that saved progress will never be lost. Some jurisdictions don't allow certain warranty exclusions, so some of these exclusions may not apply to you.

9. Limitation of liability

To the maximum extent permitted by law:

  • Long Software LLC won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, progress, or profits, arising from your use of Grove Ridge; and
  • our total liability for any claim relating to Grove Ridge is limited to the greater of (a) the amount you paid for in-app purchases in Grove Ridge in the 12 months before the claim, or (b) US $50.

Nothing in these Terms limits or excludes liability that can't be limited or excluded by law. This includes liability for death or personal injury caused by negligence, for fraud, or for gross negligence or willful misconduct, and your statutory rights as a consumer.

10. Ending these Terms

You can stop using Grove Ridge at any time by deleting it. We may suspend or end your license if you seriously or repeatedly breach these Terms. Sections 3 (no cash value), 6, 8, 9, and 11 continue to apply after these Terms end.

11. Governing law and disputes

  • These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules.
  • Any dispute will be resolved exclusively in the state or federal courts located in Virginia, and you and we consent to their jurisdiction. [COUNSEL TO CONFIRM county/venue.]
  • If you are a consumer in the EEA, UK, or Switzerland, or anywhere else where local law gives you this right, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring proceedings in the courts there. You may also use the online dispute resolution options available to you under local law.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the effective date above. If the changes are significant, we'll also give notice in the game or on this page. If you keep using Grove Ridge after changes take effect, you accept the updated Terms. If you don't agree, please stop using the game.

13. Apple-specific terms (iOS users)

If you use Grove Ridge on an Apple device:

  • these Terms are between you and Long Software LLC only, not Apple;
  • Apple has no obligation to provide maintenance or support for Grove Ridge;
  • Apple is not responsible for any product claims, IP infringement claims, or warranty obligations. Where any warranty applies and Grove Ridge fails to meet it, you may notify Apple for a refund of any purchase price, as Apple's terms provide;
  • you confirm that you are not located in a country subject to a US Government embargo, and are not on any US Government list of prohibited or restricted parties; and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a provision, we haven't waived it. You may not transfer these Terms. We may transfer them as part of a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and the applicable app store terms, are the whole agreement between you and us about Grove Ridge.
